A BILL

To provide for periodic consultation between designated officials of Guam and the Federal Government.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``Guam-Federal Consultation Act''.

SEC. 2. CONSULTATION REQUIRED.

The Organic Act of Guam (Pub. L. 117-286; 48 U.S.C. 1421 et seq.) is amended by adding at the end the following new section: ``Sec. 36. (a) The President and the Governor shall consult regularly on all matters affecting the relationship between the United States and Guam. ``(b) At the request of either Government, and not less frequently than every 5 years, designated special representatives of both the United States and Guam shall-- ``(1) meet and consider in good faith such issues affecting the relationship between such Governments as may be designated by either Government; and ``(2) submit to the Congress not later than 180 days after the conclusion of such meeting described in paragraph (1), in accordance with the requirements of the Access to Congressionally Mandated Reports Act (subtitle D of title LXXII of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023; 44 U.S.C. 4101 note prec.), a report and recommendations with respect to such consideration, issues, and relationship. ``(c) Designated special representatives shall also be appointed to meet at least one year prior to the expiration of ongoing financial assistance the Government of Guam determines is necessary financial assistance, to consider and make recommendations to the Congress and to the President regarding future, multi-year, Federal financial assistance to Guam. ``(d) For purposes of the consultation and consideration required by this section-- ``(1) the term `designated special representative'-- ``(A) with respect to the United States, means an employee or official of the Federal Government, including a special Government employee as defined in section 202 of title 18, United States Code, designated by the President to represent the United States during such consultation or consideration; and ``(B) with respect to Guam-- ``(i) means any individual jointly designated by the Governor and the Speaker of the Legislature of Guam to represent Guam during such consultation or consideration; and ``(ii) includes the Delegate to the House of Representatives from Guam; and ``(2) the term `ongoing financial assistance' means multi- year, Federal financial assistance allocated and made available to Guam.''. <all>
