A BILL

To amend chapter 44 of title 18, United States Code, to classify lethal air guns as firearms.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as ``Garrett's Law''.

SEC. 2. CLASSIFICATION OF LETHAL AIR GUNS AS FIREARMS.

(a) In General.--Section 921(a) of title 18, United States Code, is amended-- (1) in paragraph (3), by striking ``or (D)'' and inserting ``(D) any lethal air gun; or (E)''; and (2) by adding at the end the following: ``(39) The term `lethal air gun' means any weapon (other than a weapon that exclusively expels a paint-filled pellet) that expels a pellet through the force of air or gas pressure if that projectile can be one of the following calibers and feet per second, or if the weapon is otherwise designated as a lethal air gun by the Attorney General, through rulemaking, as capable of causing death: ``(A) A .177 caliber pellet expelled at a muzzle velocity of not less than 800 feet per second. ``(B) A .22 caliber pellet expelled at a muzzle velocity of not less than 500 feet per second. ``(C) A .25 caliber pellet expelled at a muzzle velocity of not less than 450 feet per second. ``(D) Any metallic pellet above .25 caliber.''. (b) Effective Date.--The amendments made by subsection (a) shall take effect on the date that is 850 days after the date of the enactment of this Act. (c) Guidance.--Not later than 365 days after the date of enactment, the Attorney General shall publish, including on the website of the Attorney General, guidance to assist manufacturers of lethal air guns in becoming Federal firearms licensees, including assistance with the application process and on compliance with requirements for licensees, including serialization and record keeping requirements. <all>
