A BILL

To amend section 133 of title 23, United States Code, to remove a certain State funding set-aside for transportation alternative programs, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``No TAP Act of 2026''.

SEC. 2. SURFACE TRANSPORTATION BLOCK GRANT PROGRAM.

(a) In General.--Section 133 of title 23, United States Code, is amended-- (1) in subsection (b)(23) by striking ``subsection (j)'' and inserting ``subsection (i)''; (2) in subsection (d)(1) by striking ``(after the set aside of funds under subsection (h))''; (3) by striking subsection (h); (4) in subsection (i) by striking ``(excluding those carried out under subsection (h)(5))''; and (5) by redesignating subsections (i) through (k) as subsections (h) through (j), respectively. (b) Conforming Amendments.-- (1) Transferability of federal-aid highway funds.--Section 126(b) of title 23, United States Code, is amended-- (A) by striking ``Certain Set-Asides'' and all that follows through ``Funds that'' and inserting ``Certain Set-Asides.--Funds that''; and (B) by striking paragraph (2). (2) Metropolitan transportation planning.--Section 134(r)(3) of title 23, United States Code, is amended-- (A) by striking ``Suballocated funding'' and all that follows through ``In determining'' and inserting ``Suballocated funding.--In determining''; (B) by striking subparagraph (B); and (C) by redesignating clauses (i) through (iii) as subparagraphs (A) through (C), respectively (and adjusting margins accordingly). <all>
