A BILL

To prohibit the expenditure of Federal funds to deploy Department of Homeland Security or National Guard employees at or near any location at which an election is taking place.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``Safe Access to the Polls Act''.

SEC. 2. PROHIBITION ON THE EXPENDITURE OF FEDERAL FUNDS FOR DEPARTMENT OF HOMELAND SECURITY OR NATIONAL GUARD PRESENCE NEAR ANY LOCATION AT WHICH AN ELECTION IS TAKING PLACE.

No Federal funds may be expended to deploy agents or officers of U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection, or members of the National Guard, who are on duty or in uniform, during any voting period-- (1) to be deployed within \1/4\ mile of any location at which an election is taking place; (2) to set up a checkpoint along any route to such a location; or (3) to interfere in any way with the ability of any eligible voter to access the location where he or she has been assigned to vote. <all>
